How to Ask for Consent and Let Others Know You Are Recording

How you provide notice and get consent to record others

Your privacy and the privacy of the people you meet with is critical. While we have developed the Pendant with privacy in mind, not everyone wants to be recorded. This is why we require all users to provide notice and obtain consent from all individuals that you seek to record before recording them.

Pendant LED light

When the Pendant is recording, it will have a visible white LED light. This light should always be facing outwards, not only to capture the best quality audio, but to also notify the people around you that you are recording them. While the LED light may help notify others that you are recording, it is not enough to simply rely on this light. You must still inform others that the Pendant is recording and offer them an opportunity to consent before continuing to record. Any efforts to hide or disable the light is a violation of our Terms.

How to provide notice and ask for consent

Most people will take their cues from you. If you’re clear and upfront, people are more likely to be receptive. When you meet someone new, you can introduce them to the Pendant and seek their consent by saying something like:

  • "This conversation is important to me and I want to remember what you say without taking notes. Is it ok if I use this Pendant to capture the conversation? I'm happy to share the transcript & summary with you afterwards if you like."

In addition to notifying them you are recording and seeking their consent, you can try a few other tactics to make others more comfortable with the recording, such as:

  • Lower your own status: “I use this because I have a terrible memory” works better than “this tool makes me superhuman.”

  • Focus on the value: “I want to make sure I fully absorb what you’re telling me”

  • Make it collaborative: Offer them transparency and control. “I’m happy to pause or remove it if you’re not comfortable.”

You should turn the Pendant off immediately if any individual you seek to record does not consent to being recorded. Once you are finished recording your conversation, turn the pendant off so that it does not continue to capture conversations that you did not intend to record.

If any individual was captured by the Pendant without their consent, you should ask them for their consent to keep the recorded audio. If they refuse, or if you are not able to obtain their consent (e.g., you unintentionally recorded a conversation of other individuals when you were not a party to such conversation) you should immediately delete the recorded audio from within the Limitless app.

Take ownership: “I use this because it really helps me be present.”

“I just wear this all the time” (with no further explanation about why)

Be specific: “This device records audio to help me remember our conversation.”

“I want everything in my life documented down” (too vague)

Keep it human: “This is my life coach and it helps me be better by giving advice on my conversations. Do you want me to show you?"

“It uses AI to give me advice” (although true, it may scare people to introduce the AI part from the start)

Pause and explain what the Pendant is before recording

Start the conversation while already recording

Be willing to share the conversation with them after, or offer the ability to delete the conversation

Omit mentioning the option to delete the conversation

Notify individuals you seek to record that the Pendant’s LED light indicates the Pendant is recording

Disable, obscure, or tamper with the Pendant LED light to hide that you are recording

Stop recording if any party does not consent to being recorded

Continue to record when the other party has not consented

Turn the Pendant on when you want to record and off when the conversation you want to record is over

Leave the Pendant on and recording at all times

Only record in places where individuals would be comfortable having a conversation recorded

Record in sensitive spaces (e.g., a doctor’s office or a bank where other people may be sharing their sensitive information) or otherwise engage in harmful activities or violate the law

What are the requirements around notice and consent?

We believe privacy is important and we recommend users of our products hold themselves accountable to a much higher standard than the bare minimum requirements. All users of our product are required to proactively provide notice and seek consent from everyone they record while using the Pendant. Not only is this a legal requirement under our Terms of Service, but it is also just the right thing to do.
